The arbitrator decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
HNTN Designs shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
If any provision of these Terms of Service is held to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be changed and interpreted so as to best accomplish the objectives of the original provision to the fullest extent permitted by law, and the remaining provisions shall continue in full force and effect.
No waiver by HNTN Designs of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure of HNTN Designs to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
These Terms of Service, together with our Privacy Policy and any service agreements or statements of work executed between you and HNTN Designs, constitute the entire agreement between you and HNTN Designs regarding the use of the Website and Service, superseding all prior and contemporaneous understandings, agreements, representations, and warranties.
HNTN Designs reserves the right to modify or replace these Terms of Service at any time at our sole discretion.
